Terms and Conditions

These Terms set out the agreement between you and BashPilot for use of the Service. Please read them carefully. We have kept the language as plain as we can while remaining precise.

1. Agreement to these terms

These Terms and Conditions (the Terms) govern your access to and use of BashPilot (the Service), operated by Bashclouds Pvt Ltd, trading as BashPilot (we, us, our). By creating an account, starting a trial or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is intended for business and professional use. By using it you confirm that you are at least 18 years old and are acting in the course of a business or profession.

2. The service

BashPilot is an AI operator for servers. You describe an outcome in plain language and BashPilot plans, executes and verifies operations on the servers you connect, across platforms such as Kubernetes, Docker, cPanel and WHM, Plesk, DirectAdmin and common Linux distributions.

The Service relies on artificial intelligence and automation. It selects operations from a reviewed catalogue and asks for your approval before anything destructive. You remain responsible for the servers you connect and for the outcomes you request.

3. Your account

You must provide accurate account information and keep it up to date. You are responsible for all activity under your account and for keeping your login credentials confidential. Notify us without delay if you suspect unauthorised use of your account.

4. Servers you connect and your responsibilities

You may only connect servers that you own or are authorised to manage, and you are solely responsible for ensuring you have the necessary rights and permissions.

The Service performs real operations on live systems. While it verifies changes and asks before destructive actions, you must not rely on it as your only safeguard. In particular, you agree to:

6. Plans, fees and billing

Paid plans are priced per connected server, per month, as shown on our pricing page. Prices are stated exclusive of taxes. Depending on your billing location, applicable taxes such as EU VAT, UK VAT or Indian GST may be added at checkout.

Payments are handled by our payment provider, Stripe. By subscribing you authorise us to charge the applicable fees to your chosen payment method on a recurring basis until you cancel.

Subscriptions renew automatically for successive periods unless cancelled before the renewal date. We may change prices with reasonable advance notice, and changes take effect at your next renewal.

7. Free trial

We may offer a free trial with a limited number of actions and a limited time. At the end of the trial the Service stops unless you choose a paid plan. We may modify or withdraw trial offers at any time.

8. Cancellation and refunds

You can cancel at any time from your account. Cancellation stops future renewals, and your access continues until the end of the period you have already paid for.

Except where required by law, fees already paid are non refundable, including for partial periods or unused actions. Where you are a consumer with a statutory right of withdrawal, that right remains unaffected.

9. Availability and support

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error free operation. The Service may be unavailable during maintenance, updates or events beyond our reasonable control.

Support is provided through the channels described for your plan.

10. Artificial intelligence and automated actions

The Service uses AI models to interpret your requests and choose operations. AI can make mistakes. Although BashPilot verifies changes against live server state and gates destructive actions behind your approval, you are responsible for reviewing what you approve. We do not warrant that automated decisions will always be correct or suitable for your particular purpose.

11. Intellectual property

We and our licensors own all rights in the Service, including its software, design and content. We grant you a limited, non exclusive and non transferable right to use the Service during your subscription. You retain all rights in your own data and content.

12. Data protection

We process personal data as described in our Privacy Policy. Where we process personal data on your behalf as part of the Service, a Data Processing Agreement is available on request. You are responsible for having a lawful basis for the data you process through the Service.

13. Warranties

To the fullest extent permitted by law, the Service is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Statutory rights that cannot be excluded remain unaffected.

14. Limitation of liability

Nothing in these Terms limits or excludes our liability where it cannot lawfully be limited. Our liability is unlimited for damages arising from injury to life, body or health, for damages caused intentionally or by gross negligence, under any guarantee we have expressly given, and under mandatory product liability law.

For damages caused by simple (ordinary) negligence, we are liable only where we breach a material contractual obligation, meaning an obligation whose fulfilment is essential to the proper performance of the contract and on which you may reasonably rely. In that case our liability is limited to the foreseeable damage typical for this type of contract.

Subject to the paragraphs above, our total aggregate liability for all claims arising out of or in connection with the Service in any twelve month period is limited to the total fees you paid for the Service in the six months immediately before the event giving rise to the claim.

To the extent permitted by law, we are not liable for loss of data where you have not maintained appropriate backups, nor for indirect or consequential loss.

15. Your indemnity

To the extent the claim results from your own fault, you agree to hold us harmless from third party claims and losses arising from your misuse of the Service, your breach of these Terms, or your use of the Service on servers you were not authorised to manage.

16. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that risks harm to the Service, to us or to others. Where reasonable, we will give you notice and an opportunity to fix the issue. You may stop using the Service and close your account at any time.

17. Changes to these terms

We may update these Terms to reflect changes to the Service or for legal reasons. We will give reasonable notice of material changes, for example by email or within the app. If you continue to use the Service after the changes take effect, you accept the updated Terms.

18. Governing law and jurisdiction

These Terms are governed by the laws of India, excluding its conflict of law rules. Where you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected.

Where you are a business, the courts of Kerala, India have exclusive jurisdiction for disputes arising from these Terms.

19. Final provisions

If any provision of these Terms is or becomes invalid, the remaining provisions stay in effect, and the invalid provision will be replaced by a valid one that comes closest to its intended purpose.

We may transfer our rights and obligations under these Terms to a successor entity. Your rights under these Terms will not be reduced as a result.
